Your privacy is important to us!

We want to process your personal data in a legal, correct and transparent manner. In this privacy statement we explain which personal data of yours as a natural person we process and what the purposes are. Furthermore, it is also explained what rights you have to guarantee and possibly improve your privacy. Finally, we inform you about the security measures we take to protect your personal data.

1. who are we?

Your data will be processed by Jacon Plus Consulting BV, further called Jacon Plus, with registered office at 1730 Asse, Bloklaan 2 box 4, registered with the Crossroads Bank for Enterprises under the number 0859.582.425.

Jacon Plus declares that as Controller they comply with Belgian privacy law, as well as the provisions of the General Data Protection Regulation from its entry into force. Within our organization the data is only accessible to authorized persons who must have access to it depending on their duties.

2. what is personal data?

The General Data Protection Regulation defines personal data as follows:

any information about an identified or identifiable natural person; an identifiable person is a natural person who can be identified, directly or indirectly, in particular by means of an identifier such as a name, an identification number, location data, an online identifier or one or more elements that are characteristic of the physical, physiological, genetic, psychological, economic, cultural or social identity of that natural person.

If this Privacy Policy refers to personal data, reference is made to this definition from the Regulation.

No special categories of personal data are processed. Processing of special categories of personal data means:

Processing of personal data revealing racial or ethnic origin, political views, religious or philosophical beliefs, or membership of a trade union, and processing of genetic data, biometric data for the unique identification of a person, or data on health, or data relating to a person's sexual behavior or sexual orientation.

3. what personal data is processed?

3.1 data that we collect directly:

  • To know who you are: Name, first name and/or position
  • To contact you: Telephone number and/or email address

3.2 data that we receive directly from you as a client (in the context of our service provision):

This happens when you apply on our website to receive information on our management consultancy services.

We collect and process various personal data. This concerns the following personal data:

Contact information: name, first name, email address, language, telephone number, mobile phone number, address, etc.

3.3 public data and data that we collect indirectly:

Jacon Plus sometimes processes public data.

This may include, for example, data that is subject to a publication obligation, such as the publication of your appointment as a director of a company, or data that you have made public yourself, such as information on your website, social media, etc.

This may also be data that is public, for example because it is generally known (in your area) or because it has appeared in the press. This also includes information on, for example, the Crossroads Bank for Enterprises.

3.4 what you tell us may be processed:

If you contact us by telephone, our reception may record your first name, name, telephone number and email address in order to build up a contact overview and to see who uses our services.

4. why is this personal data processed and what is the legal basis?

Depending on the situation, Jacon Plus needs certain information from you to be able to offer certain services. The information requested by Jacon Plus and with which we can identify you is called personal data. Below you can verify for each situation why Jacon Plus requests this personal data and for what purpose your personal data will be used.

Depending on the case, your data will be used for the following purposes, always in the context of providing you with management advice:

  • For suppliers, the personal data necessary for the implementation of the agreement is collected. This mainly concerns email addresses and telephone numbers of contact persons to simplify communication.
     
  • For contacts with clients or prospects at the time of initial contact with Jacon Plus: your data is necessary to be able to correctly implement the agreement you conclude with us. Because you enter into a contract with us, we must have access to the necessary personal data to be able to offer our services that are included in the contract.
     
  • Potential new contacts by handing over business cards or by connecting via LinkedIn: if you handed us a business card in any way, we will include you in our database. We assume here that by handing us your business card you and/or the connection you also give your explicit permission to be included in our database.
     
  • In addition, we also store the publicly accessible data we find about you in our database. We assume that we may also retain this personal data since you have made it publicly available.

5. who receives my personal data?

In principle, your personal data is not passed on to other parties. Jacon Plus processes this personal data in accordance with the purposes stated under point 4.

Only employees within our organization who need your personal information in the performance of their duties will be able to consult it.

When organizing events, we may pass on your personal data (such as name and first name) to external parties who organize the events, and this purely for organizational and also security reasons.

6. for how long is my Personal Data stored?

Your personal data will be stored for as long as necessary to achieve the goals as described under point 4.

Your personal data will in any case be kept passively in accordance with the limitation periods that oblige us to keep your personal data longer.

Your file will then be saved in archived form.

For candidates, we store and process personal data at least as long as the selection process is ongoing.

7. what are my rights in terms of the protection of my personal data?

7.1 right of access and inspection

You have the right to access your personal data free of charge at any time, as well as the use that we make of your personal data in accordance with the provisions that apply within the sector.

Jacon Plus will give you a complete overview of the personal data that is kept about you. We can already confirm that no special categories of personal data are kept (such as race, ethnic origin, health data, data on sexual orientation, etc.).

You may obtain a copy of the personal data that is collected.

7.2 right to correction, erasure and limitation

You are free to communicate your personal data to us or not. In addition, you always have the right to request that we correct, supplement or delete your personal data.

You may also request a limitation of the processing of your personal data.

7.3 right of objection

You also have a right to object to the processing of your personal data for serious and legitimate reasons. If you are of the opinion that we process certain personal data on an unlawful basis, i.e. without having a correct purpose, you may ask for the deletion of your personal data.

7.4 right of data transfer

You have the right to obtain your personal data processed by us in a structured, common and machine-readable format and/or to transfer it to other authorized persons in accordance with the provisions that apply in the sector. The Regulation does provide for a number of restrictions to this right, so that this does not apply in all cases. This must of course be reviewed case by case.

7.5 right of withdrawal of consent

Insofar as the processing is based on your prior consent, you have the right to withdraw said consent. We will then be obligated to delete your personal data.

7.6 automatic processing, decisions and profiling

Some data processing and processes are fully automated without human intervention. The processing of your personal data does not include profiling and you will not be subject to automated decisions by us. However, we make no use of this with regard to the processing of your personal data. If this were the case after all and if you do not agree with such a fully automated process, you may lodge an objection on the matter, so that your personal data will no longer be processed in this way.

7.8 complaints

You have the right to submit a complaint to the Belgian Privacy Commission: Commission for the Protection of Privacy, Drukpersstraat 35, 1000 Brussels, tel. +32 (0) 2 274 48 00, fax +32 (0) 2 274 48 35, e-mail: commission@privacycommission.be. This is without prejudice to any action before a civil court.

If you should incur any damage as a result of the processing of your personal data, you may file a claim for damages.

8. transfer to third parties

Your personal data will not be sold, rented, distributed or otherwise made commercially available to third parties, except with your prior permission.

In rare cases, we may be required to disclose your personal information pursuant to a court order or to comply with other mandatory laws or regulations.

9. security and confidentiality

We have developed security measures that are adapted on a technical and organizational level to prevent the destruction, loss, falsification, alteration, unauthorized access or accidental disclosure to third parties of collected personal data as well as any other unauthorized processing of this data.

10. Changes to this privacy statement This privacy statement is not a static document, it can and will undergo a number of changes over time. As we make changes, we will update the date on which it was last changed. Changes we make to this Privacy Statement will take effect immediately.
